These Terms of Service govern your access to and use of the Klyx mobile application, website, NFC wristbands, QR codes, public profiles, tipping features, recognition tools, promotions, and related services. By creating an account, activating a wristband, or using Klyx, you agree to these Terms.
1. Eligibility and accounts
You must be legally able to enter into a binding agreement and meet any minimum age required in your location. You must provide accurate information, keep it current, protect your login credentials, and promptly tell us about unauthorized access. You are responsible for activity under your account. Klyx may require identity, workplace, tax, or payment verification before enabling certain features.
2. Klyx profiles, wristbands, and interactions
Klyx provides tools that connect customers to a service professional’s public profile through an NFC tap, QR scan, or link. Customers may choose to tip, leave a compliment, follow a social account, or visit a third-party review page. You are responsible for ensuring that your profile content, workplace associations, social links, and requests are accurate, lawful, and appropriate. A Klyx wristband remains subject to availability, activation requirements, and replacement rules shown in the app.
3. Tips, payments, and payouts
Tips are voluntary payments from customers and are processed by Stripe or another disclosed payment provider. You must complete required onboarding and provide accurate payout and tax information. Processing times, availability, holds, refunds, chargebacks, currency conversion, minimum payout amounts, and fees may depend on the payment provider and your location. Klyx does not guarantee that a customer will tip or that a payment will be completed. You are responsible for reporting and paying taxes associated with amounts you receive.
4. Reviews, social platforms, and workplaces
Google, Instagram, TikTok, Stripe, and other third-party services are independent from Klyx and governed by their own terms and policies. Klyx does not control whether a review is published, a social follow is completed, or a third-party account remains available. You must not pressure customers, purchase reviews, manipulate ratings, or use Klyx in a way that violates a platform’s rules or your workplace policies.
5. Promotions and free wristbands
Promotions, including free wristbands or interaction bonuses, may be limited by time, location, eligibility, inventory, account status, and separate promotion terms. Klyx may verify qualifying interactions, reject duplicate or fraudulent activity, change or end a promotion, and substitute a reward where permitted by law. Unless stated otherwise, rewards are not transferable and have no cash alternative.
6. Acceptable use
You may not use Klyx for unlawful, deceptive, abusive, discriminatory, harassing, or fraudulent activity; impersonate another person; submit false interactions; interfere with security; reverse engineer the service; scrape or automate access without permission; upload harmful code; infringe intellectual property or privacy rights; or use Klyx to process prohibited payments. We may investigate, limit, suspend, or terminate access when we reasonably believe these Terms or applicable law have been violated.
7. Ownership and feedback
Klyx and its licensors own the service, software, designs, trademarks, and related content. We grant you a limited, personal, revocable, non-exclusive, non-transferable license to use Klyx in accordance with these Terms. You retain ownership of content you submit and grant Klyx permission to host, display, process, and distribute it as needed to operate and promote the service. Feedback may be used without restriction or compensation.
8. Disclaimers and limitation of liability
Klyx is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not guarantee uninterrupted access, specific earnings, recognition, reviews, followers, workplace outcomes, or compatibility with every device or third-party service. To the fullest extent permitted by law, Klyx and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, data, reputation, or business opportunity. Where liability cannot be excluded, our aggregate liability will not exceed the greater of amounts you paid directly to Klyx in the preceding twelve months or USD $100.
9. Suspension, termination, and changes
You may stop using Klyx or request account deletion at any time. We may modify, suspend, or discontinue features and may suspend or terminate accounts for security, legal, operational, or policy reasons. Provisions that by their nature should survive termination will continue to apply. We may update these Terms; continued use after the effective date of updated Terms constitutes acceptance where permitted by law.
10. Governing terms and contact
These Terms, together with the Privacy Policy and any promotion-specific terms, form the agreement between you and Klyx. Any mandatory consumer protections in your location continue to apply.
